Watch Circle Terms and Conditions

Effective 27 September 2026. Please read these terms before submitting a request or joining Watch Circle. They apply to search and sale requests, referrals to dealers and workshops, and coordination of inspections or delivery. They do not replace the terms for products sold directly by the Malichus store. If an offer or invoice names Malichus as the seller, that sale and its statutory consumer rights are governed by the applicable direct-sale terms and law.

1. Malichus’s role and the scope of the service

Through Watch Circle, Malichus receives requests, reviews initial information, introduces customers to suitable sellers or workshops, and helps coordinate next steps. An inspection or delivery may be arranged under a separate agreement. Unless a particular offer or invoice expressly identifies Malichus as the seller or service provider, the sale or repair contract is between the customer and the seller or workshop. A fee or commission paid to Malichus by a participant does not, by itself, make Malichus the product’s owner or a party to the sale.

Accepting a request, listing an item, describing a business as a partner, or reviewing photos and documents does not mean that a physical inspection has taken place or that Malichus guarantees authenticity, condition or title. Malichus will state in writing whether an item was physically inspected, who performed the inspection, its scope and limits, and whether a separate written warranty applies. An item must not be described as “verified” or “authenticity guaranteed” without a specific written assurance to that effect.

2. Eligible items and authenticity

Watch Circle covers watches, gold or silver jewelry, watch accessories, and selected luxury collectibles that Malichus agrees to consider. Counterfeit or replica items, and items presented with misleading brands or descriptions, may not be listed, referred or sold through the initiative, even if disclosed as “copies.” Before an agreement is made, the seller must disclose replaced or non-original parts, modifications, repairs, defects, and available provenance and ownership documents. Jewelry descriptions, metal content, hallmarking and fineness must meet the rules applicable in the country of the transaction.

3. Sellers and dealers

A seller confirms that they are entitled to sell the item and that the information, images and documents supplied are accurate and not misleading. The seller is responsible to the buyer for authenticity, title, condition, description, delivery, invoicing, warranties, and any refund or remedy required by law. Sellers must cooperate with verification requests and complaints and provide relevant records. Where there is a reasonable concern, Malichus may suspend or remove a listing or referral, end the relationship, and report the matter to the competent authority where appropriate under applicable law.

4. Workshops and service providers

Before work begins, the workshop must give the customer written details of the scope of work, price and currency, replacement parts, expected time, warranty, and any effect the work may have on the item. The workshop is responsible for its work, custody and safety of the item, and the legal duties associated with its service. It must flag suspected counterfeits or material discrepancies and must not pronounce an item authentic on the strength of a limited examination. Malichus’s coordination of an appointment does not guarantee the outcome of the service. If Malichus itself undertakes a defined service, it remains responsible for its own conduct as required by law.

5. Inspections and their limits

Verification may involve only a preliminary review of photos and information. A physical examination by an independent specialist takes place only if expressly offered and agreed. An inspection report reflects the item, its condition, and the components that could be examined at the time, using the methods stated in the report. A limited inspection may miss defects, alterations or sophisticated counterfeits. It is not an absolute or continuing guarantee, and it does not remove the buyer’s rights against the seller or any responsibility imposed by law on the person who performed the inspection. Where available, the report, item identifier, photos and handover record should be retained.

6. Agreement, prices and payment

The final price, currency, taxes, charges and any commission payable by a party will be disclosed before that party commits. Malichus agrees its commission separately in writing with the relevant dealer, workshop or seller. Under the current model, buyers pay no brokerage commission unless a separate service fee is presented and expressly accepted before that service is provided. When buyer and seller agree and pay each other directly outside the Malichus store, Malichus does not hold the purchase price in escrow and cannot refund money it has not received. This does not limit a customer’s claim against the responsible party or statutory rights. Do not submit card details through request forms or insecure messages.

7. Delivery and handover

Selecting delivery only asks whether it is available. The provider, destination, carrier, charges, timing, insurance and responsibility for handover must be confirmed in writing before the customer agrees. Merely selecting “Yes” does not incur a delivery charge. Each party remains responsible for its own acts and shipping or coordination duties under the agreement and applicable law. Appointing a carrier does not remove any duty that cannot lawfully be excluded.

8. Complaints and suspected counterfeits

If you suspect a counterfeit or a material discrepancy, stop dealing with the item and preserve photos, the invoice, communications and any independent inspection report. Email info@malichus.com with the request number. Malichus will review the report, seek the relevant party’s response, and may suspend the listing or referral, help exchange documents, or refer the matter to the competent authorities. Malichus does not impose a reporting deadline that extinguishes statutory rights. Its assistance with a dispute does not, by itself, mean that it was the seller or conclusively determine authenticity. Consumers may pursue the seller, competent authorities or courts as permitted by law.

9. Responsibility and rights preserved

Each party is responsible for its own statements, conduct, contractual promises and legal duties. When Malichus acts as an intermediary between independent parties, an introduction or coordination alone does not transfer the seller’s or workshop’s duties to Malichus. These terms do not exclude liability that applicable law imposes on Malichus for its own conduct, gross negligence, fraud or an express undertaking, nor do they reduce consumer rights that cannot be waived. Any limitation of liability applies only to the extent permitted by the law governing the matter.

10. Data and privacy

Request data is used to communicate, assess suitability and coordinate with an appropriate party to the extent needed for the service, in accordance with the Privacy Policy. Opting in to Malichus news and offers is voluntary and separate from acceptance of these terms; you may unsubscribe. A cross-border referral may require sharing necessary data with a party in another country after the purpose and applicable safeguards are explained.

11. Changes and disputes

These terms may be updated for future requests, with the version date shown. Malichus will retain, where practicable, the version accepted when a request was submitted. Complaints should first be raised with Malichus and the relevant party, without affecting the right to approach a competent authority or court under applicable law. If a provision conflicts with a mandatory rule, that rule prevails and the remaining provisions continue to the extent valid.

Applicant acknowledgement: By submitting a form, I confirm that I have read these terms and understand Malichus’s role, the limits of any inspection, and the seller’s or workshop’s responsibility for the item or service. My statutory rights remain intact. Submitting a request does not guarantee acceptance or conclude a transaction.
